Terms and Conditions
1 – INTRODUCTION

These Terms and Conditions apply to all Biba Bon Services, including the Biba Bon Mobile App and Biba Bon Card, where you can save and/or redeem your Biba Bon Points. The Biba Bon Services are available in Curaçao. You'll need suitable hardware, software, and internet access to utilize the Biba Bon Services.

2 – TERMS AND CONDITIONS OF USE

You acknowledge that you have read, understood, and accepted these Terms and Conditions by downloading, browsing, accessing, or using the Biba Bon Mobile App. At any time, we have the right to change these Terms & Conditions. If you disagree with any of these Terms and Conditions, you must stop using the Biba Bon Mobile App and stop using the Biba Bon Services immediately. Acceptance of these Terms and Conditions is implied by continued use of the Biba Bon Mobile App and the Biba Bon Services.

3 - DEFINITIONS
​
Except when the context indicates otherwise, the terms in these Terms and Conditions will have the following meanings: The Biba Bon Card is a savings card that allows you to accumulate Biba Bon Points. Users of the Biba Bon Mobile App, including you, are considered members. The term "save" refers to the act of storing Biba Bon Points. Biba Bon Mobile App - the Biba Bon Mobile App is a mobile application that Members may download and use on their smart devices to save and redeem Biba Bon Points. Account - a personal account created by a Member as part of the registration process on the Biba Bon Mobile App; Biba Bon Points - the points you get when you make a purchase of certain products or services from Merchants; Redeeming Biba Bon Points is referred to as "Redemption," and the process of redeeming Biba Bon Points is referred to as "Redemption." Wallet - a secure digital wallet for storing E-vouchers that have been purchased; Any entity whose products or Samples can be purchased and/or redeemed (as the case may be) via the Biba Bon Mobile App is referred to as a Merchant. The privacy policy set forth in clause N of these Terms and Conditions is referred to as the "Privacy Policy."

4 – THE BIBA BON MOBILE APP
​
Terms and Conditions Applicability: These Terms and Conditions apply to all Biba Bon Services and/or the Biba Bon Mobile App. Equipment and Networks: You will need Internet access and sufficient telecommunication links to utilize the Biba Bon Mobile App or Biba Bon Services. When using the Biba Bon Mobile App, you recognize that the conditions of your agreement with your respective mobile network provider ("Mobile Provider") will continue to apply. Location: We make no representation that the Biba Bon Services will be available or suitable for use outside of Curaçao. Regardless of the foregoing, if you use the Biba Bon Mobile App or use the Biba Bon Services from a location other than Curaçao, you do so on your own initiative and are solely responsible for the consequences and compliance with all applicable laws. If you want to quit using the Biba Bon Mobile App, send an email to the email address listed on our website. Within 10 working days of receiving your request, your deregistration will take effect.

5 - SAVINGS
​
The Account is credited with the saved Biba Bon Points, which have a standard value of Ang. 0.015 per Biba Bon Point. However, for special campaigns, this value may be higher at certain Merchants during specific periods of time. You can use the Biba Bon Mobile App or the Biba Bon Card to save Biba Bon Points. For an up-to-date summary of your transactions and Biba Bon Points balance, use the Biba Bon Mobile App. Merchants have the ability to delete and/or add products or services that can be used to earn Biba Bon Points.

6 - REDEMPTIONS
​
Registration is required: In order to redeem from the Biba Bon Mobile App, you must first register. Redemption: At our judgment, any attempted Redemption that is not compatible with these Terms and Conditions may be denied or made void.

7 – The Biba Bon Points are canceled.
​
If you do not use the Biba Bon Mobile App or Biba Bon Card for more than one year, your Biba Bon Points will be deleted without warning and without compensation.

8– RULES FOR USE OF THE BIBA BON MOBILE APP AND THE SERVICE
​
We make no guarantee that your use of the Biba Bon Services or the Biba Bon Mobile App will be interrupted, and we make no guarantee that any information (or messages) supplied via the Biba Bon Services or the Biba Bon Mobile App will be accurate, reliable, timely, or at all. Despite our best efforts to provide continuous access to the Biba Bon Services and the Biba Bon Mobile App, we reserve the right to suspend, restrict, or terminate access to the Biba Bon Services and the Biba Bon Mobile App at any time. We reserve the right to restrict access to, alter, or remove any material that we believe, in our sole discretion, may violate these Terms and Conditions.

9 - TERMINATION
​
If you use the Biba Bon Mobile App or any Biba Bon Services in violation of these Terms and Conditions we may stop your usage of the Biba Bon Services and/or Biba Bon Mobile App.

10 – DISCLAIMER AND LIABILITY EXCLUSION

We do not guarantee that the Biba Bon Mobile App will always be available, uninterrupted, timely, secure, error-free, or free of computer viruses or other invasive or damaging code, or that the Biba Bon Mobile App will not be harmed by acts of God or other force majeure events, such as inability to obtain or shortage of necessary materials, equipment facilities, power, or telecommunications, lack of telecommunication equipment's or facilities, or failure of telecommunication equipment's or facilities. We will not be liable for any acts or omissions of third parties, or for any direct, indirect, incidental, special, consequential, or punitive damages, resulting from or in connection with the Biba Bon Mobile App and the Biba Bon Services, your access to, use of, or inability to use the Biba Bon Mobile App or the Biba Bon Services, reliance on or downloading from the Biba Bon Mobile App and/or services, or reliance on or downloading

11 – RIGHTS TO INTELLECTUAL PROPERTY
​
On the Biba Bon Mobile App, all editorial content, information, photographs, illustrations, artwork, and other graphic materials, as well as names, logos, and trademarks, are protected by copyright laws and/or other laws and/or international treaties and belong to us and/or our suppliers, as the case may be. Unless expressly permitted by us and/or our suppliers, these works, logos, graphics, sounds, or pictures may not be duplicated, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted, or circulated in whole or in part. Nothing on the Biba Bon Mobile App should be construed as granting any license or right to use any trademark displayed on the Biba Bon Mobile App without our written permission, whether by implication, estoppel, or otherwise. It is forbidden to utilize any trademarks or other content published on the Biba Bon Mobile App for commercial purposes.

12 – JURISDICTION AND APPLICABLE LAW

You understand and agree that in the event of a dispute arising out of or in connection with these Terms and Conditions of Use, both you and we will submit to the exclusive jurisdiction of the Curaçao courts.

13 - PRIVACY POLICY

The Privacy Policy governs Biba Bon Software Innovation's and/or its group of companies' access to the Biba Bon Mobile App and usage of the Biba Bon Services available on the Biba Bon Mobile App. You are deemed to have accepted the Privacy Policy by accessing the Biba Bon Mobile App and continuing to use the Biba Bon Services offered, and in particular, you are deemed to have consented to our use and disclosure of your personal information in the manner prescribed in the Privacy Policy. We retain the right to make changes to the Privacy Policy at any time. If you disagree with any aspect of the Privacy Policy, you must stop using the Biba Bon Mobile App and stop using the Biba Bon Services immediately. We collect, utilize, and, in some situations, share information about you to third parties as part of the normal functioning of our Biba Bon Services. As a result, we've created this Privacy Policy so that you know how we collect, use, communicate, disclose, and use your personal information when you use the Biba Bon Services on the Biba Bon Mobile App: Personal information should be relevant to the purposes for which it is to be used, and it should be accurate, complete, and up-to-date to the degree necessary for those purposes. We shall employ reasonable security procedures to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use, or alteration. We are committed to operating our company in accordance with these principles in order to safeguard and maintain the confidentiality of personal information. We refer to the account settings in the Biba Bon Mobile App for a more detailed discussion of the Privacy Policy. We shall identify the purposes for which personal information is being collected before or at the time of collection. Unless we receive the consent of the individual concerned or as required by law, we will collect and use personal information solely for the purposes indicated by us and for other complementary reasons. We shall only keep personal information for as long as it is required for those reasons. We will acquire personal information in a legitimate and fair manner, with the knowledge or agreement of the individual concerned, if appropriate. By using Biba Bon's services, you signify your acceptance of these terms.

14 - Lucky Number WNK Sweepstakes Program
a. All members registered in the Biba Bon App can participate to win Chin Chin (points) every day in the Lucky Number WNK Sweepstakes.
b. Registered members who make purchases at participating merchants, and are granted Chin Chin (points) automatically participate in this daily drawing.
c. Upon granting Chin Chin to a member upon purchase made at a participating merchant, automatically a random 4-digit number will appear in the upper right corner of the member’s Biba Bon App.
d. This 4-digit number will participate in the daily local Wega di Number Korsou (WNK) sweepstakes drawing. If the 4-digit number is drawn as the first prize in the WNK drawing of that day, the member will win the daily prize.
e. The daily prize is 1,000 Chin Chin (points).
f. if there is no winner, the prize will roll over to the next day, up to a maximum of 30,000 Chin Chin (points)
g. Participation in the daily is FREE for all members.
h. Participation in this sweepstakes is only for members 18 or older.
